摘要
集体建设用地使用权不能简称为集体土地使用权 ,权利主体包括农民个人、土地所属集体社区以外的组织 ,权利客体为乡村非农建设用地 ;其取得方式主要有批划、买卖、初始登记和继承 ;权利人对于建设用地可以占有、使用、收益 ,其中的使用权应包含权利转让权、权利投资权和抵押设定权 ,作为用益权 ,权利人就享有物上请求权 ;其终止原因有土地灭失、放弃、权利人死亡、期限届满、国家征用等。
The collective-owned construction land use right can not abbreviate to the collective-owned land use right. The subject of right contains individual peasant and organizations expect collective communities who own the land. The object of right is unrural construction land in countryside. The main procuring methods are through sales and purchases, initial registration or inheritance. The creditor has right to possess, use the land, or to get revenues from it. Among these, the land use right consists of assignment right, investment right and mortgage right towards the land; meanwhile revenues right means a creditor has request right to his possession. The extinguishment of land, renouncing or death of the creditor or government requisition of land may cause the termination of land use right. Laws should not strictly forbidden the collective-owned construction land use right to be negotiable in markets.
