完善私人财产权法律保护制度的几点思考

我国长期以来对私人财产权缺乏周到的法律保护,现行法律同样存在明显不足。完善私人财产权的法律保护制度不仅有利于建立良好的社会环境和稳定的市场秩序,而且是经济发展的保障和人格完善的基础。当然,在保护私人财产权的同时,不能妨碍国家因社会公共利益需要对私人财产进行征用。国家对私人财产权法律保护制度的完善应该遵循必要的原则。

There has been a lack of thorough law protection of private property in China for a long time, and the situation still exists in the present law. Perfecting law-protecting system of private property will not only be beneficial for establishing healthy social environment and steady market order but also a guarantee for economic development and a basis of personality perfection. Meanwhile, the expropriation of private property for the public interest should not be hindered. Necessary principles should be followed when perfecting law-protecting system of private property.
