The paper attempts to discuss the issue in relation to globalized law,modern society,and the socialist legal construction in China.Finally,it is suggested that attention should be given to relationships with necessity and choice,originality and innovation,conditions and processes,and generalities and particulars in the socialist legal modernization in China.
