敦煌遗书一宗后晋时期敦煌民事诉讼档案

Study of The Lawsuit Document for a Civil Case of Houjin Dynasty(936-946) Found in Dunhuang MS

敦煌遗书P 32 5 7《后晋开运二年 (94 5 )敦煌寡妇阿龙诉讼案卷》是我国古代法学史及档案史方面的珍贵遗存 ,早已引起敦煌学界的重视与探讨。但由于时移世变 ,古今揆隔 ,原卷文字又间有残缺、讹误 ,诸家理解难免参差不一。笔者特予整理过录并加注释 ,以提供一个尽可能完善的释读文本。在此基础上 ,笔者又着重对本卷在我国法学史、档案学史方面的价值意义进行了探讨 ,以揭示本卷重要的学术内涵。

Dunhuang MS, P.3257 is a piece of valuable and an important lawsuit document that had recorded a civil case of the Dunhuang citizen, a widow named A-Long's. The complete document of civil lawsuit case that dated from the second year of Kaiyun of Houjin Dynasty(936-946). This existing document has great significance for us to understand the ancient history of science of law and classic documentation history. Since it was so important that had already arose great interesting to scholars who had made much effect in study of it in earlier times. But there are many difficulties that are in the way to hinder the better achievements on the study of the rare document of lawsuit, such as following cases: wrong transcripts; wrong in interpretation?correction and interpretation to the document had made wrong way to put a right interpretation on the words or expressions while the scholars present their views. This article try to present a studied copy of the document with annotation in order to offering a better proof-reading text for further study. Based on above works that has been done, the author stress the great value of the text both on value of study of the ancient history of science of law and classic documentation history and academic connotation exist on the lawsuit document.
