摘要 辞职权的具体适用在理论界和实务界都存在较大的争议,尚未达成共识,笼统的讨论辞职权存在较大的困难。从新的角度,采用分类讨论的方法加以研究论证,辞职权可以分为法定辞职权和约定辞职权,前者又进一步分为无条件辞职权和有条件辞职权,各类辞职权具有各自的性质、特点,在适用条件、适用范围、行使方式和责任承担上都有很大的不同。为有关辞职权的司法实务提供一套具体的、具有可操作性的规则是当前理论研究的重点。 There are a lot of arguments about but no agreement on the judicial application of the right to resign either in theory or practice. It is pointless to discuss the issue of the right to resign on a general basis. In order to study the right to resign, this article introduces a way of classification, and a new point of view. The right to resign can be classified into the legal and conventional rights to resign. The former can be further classified into the conditional and unconditional resignation. Each type of resignation has its own characteristics, conditions and scope of application, means of enforcement and liabilities. The focus of theoretical research for the time being is the formulation of a concrete and operational framework within which the law can be effectively enforced.
