网络环境下我国著作权合理使用制度存在的必要性

近年来 ,国际互联网的发展突飞猛进 ,它在改变人们生活方式的同时 ,也使得一些原有的权益天平发生了倾斜 ,作为平衡版权作品所有者、传播者和使用者三方利益的著作权合理使用制度 ,正受到前所未有的冲击 ,合理使用甚至成为网络侵权的借口 ,网络也似乎成了不受约束的“自由王国”。网络环境下著作权合理使用制度存在的客观环境尽管发生了变化 。

In the copyright areas,“fair use”plays a very important role in balancing the benefit between the copyright owner and the user.However,with the rapid development of science and technology,especially the spread of the computer and the Internet,it is easier to write,disseminate and use works than ever.The economic basis of “fair use”has totally changed already and the range of “fair use”in our counter is much wider than in other countries.To adapt to the current environment,the adjustment of“fair use”is an urgent and necessary task facing the government. By drawing on the experience of other countries and taking our present conditions into account,this article puts forward“fair use”among users,the relationship between technological measures and“fair use”etc.In a word,in order to improve the legal protection system,this author hopes more learns to make further studies and explorations about“fair use”in a net world.
