摘要
诉讼文化包括诉讼制度文化和诉讼观念文化 ,二者关系密切。诉讼制度的现代化必须以诉讼观念的现代化为先导。传统诉讼文化追求无诉等价值目标 ,成为制约诉讼制度现代化的主要因素。诉讼制度现代化的关键 ,在于反思和重构诉讼观念。
Lawsuit culture includes lawsuit system culture and lawsuit thought culture,and they are in close reletions.Lawsuit system modernization must be based on the lawsuit thought modernization.Traditional lawsuit culture's pursuing the value goal of no litigation becomes the main factor of restricting lawsuit system modernization.The key of lawsuit system modernization lies in rethinking and reconstructing the lawsuit thought.
