试论行政违法的原因与治理对策

The Analysis of the Causes and Solutions of the Administrative Violation

行政违法案件主要表现为行政失职、行政越权、行政滥用职权、事实依据错误、适法错误、行政侵权等形式,并较多发生于行政许可、行政审批、行政检查、行政收费及行政处罚等执法活动中。本文从我国传统文化、行政理念、行政体制弊端、行政人员素质几个方面分析了产生行政违法的主要原因,并从制度建设和教育两个方面探讨了治理对策,以求标本兼治。

The increasing cases of administrative violation have drawn public attention. The cases mainly include the neglect of duty, the exceeding in one's power, the misuse of power, the mistaken evidence, the misapplication of regulations, and the administrative right violations, etc. These violations constantly occur in the executive activities of administrative permit, authority approval and inspection, executive charges and fines. This paper is aimed to analyze the major causes of the cases from the perspective of Chinese cultural tradition, the notion of what is administration, the drawbacks in the administrative system and the stuff qualities. Finally some suggestions to deal with the situation are proposed.
