Legal Mechanism in the Evolution of the Relationship of Rites and Penalties

中国古代法制不断走向成熟的过程,就是礼、法关系由分立、对立到合流的发展过程。在此过程中,实现了古代法律与道德的结合,使法律道德化或道德法律化,形成了中国古代独特的法律传统。

Rites were regarded as the core of law in ancient China, and the integration of rites and penalties was considered as the most important tradition and feature of the legal system in the ancient time. The process of maturity of ancient legal system is found to be a development from confrontation to integration of rites and penalties. As a result of the integration of the two aspects, the law became a moralized law or a legalized moral. Thus a legal tradition with Chinese characteristics was formed in ancient China.
