完善侵犯商业秘密犯罪的立法思考

On the Law about the Infringement of Commercial Secrets

刑法在规定惩治侵犯商业秘密犯罪的范围上应加以必要的限制。我国1997年修订的刑法明确规定的侵犯商业秘密罪,对制裁该犯罪发挥了积极的作用,但该立法规定存在诸多缺陷。为完善侵犯商业秘密犯罪的立法,建议将侵犯商业秘密罪限定在非法使用和非法泄露的故意犯罪,并适当降低该罪的法定最高刑。

The Criminal Law of China (1997) provides articles concerning the crime of infringement of commercial secrets. For the improvement of the law, this article suggests that differentiate the crime of illegal use from the crime of illegal leakage of commercial secrets, and the law should to a certain extent lower the maximum sentence of the crime.
