社会转型时期单位犯罪的成因与打防对策探析

Study on the Causes of and Measures against the Unit Crimes in the Social Transitional Period

随着我国社会由计划经济向市场经济的转型,单位犯罪现象在社会生活中开始衍生并逐步蔓延。近年来,在全国检察机关立案查处的犯罪案件中,单位走私、偷税、骗税、制售假冒伪劣产品、贿赂等犯罪案件大幅度上升。单位犯罪严重损害了党和政府的形象,破坏了国家的经济建设,在人民群众中造成了极坏的影响。探讨单位犯罪的成因以及建构单位犯罪的预防机制,对于有效打击单位犯罪行为,扼制其发展蔓延,具有重要的理论意义和现实意义。

With the social transition from a planned economy system to a market economy system, the phenomenon of unit crimes begins to derive and increases progressively in social life. In the crime cases that the national procuratorial organs have investigated and prosecuted in recent years, the offenses of unit smuggling, evading and deceiving taxes, making and selling of the fake and forged products, and bribery have increased by a large margin. Unit crimes severely damage not only the image of the CPC and the government, but also the economic construction of our country. Probing into the causes of unit crimes, this paper puts forward a prevention mechanism, which will effectively attack the crimes and contain their development and spread.
