A Study of Civil Liability in Commercial Instrument Law

票据法上的民事责任不同于票据责任和一般法上的民事责任。构建我国票据法上的民事责任制度体系,对于救济票据权利人的利益、制裁违法票据行为以及完善票据立法具有重要意义。我国票据法上的民事责任制度的框架体系,应当包括票据返还责任、利益返还责任、损害赔偿责任以及票据原本的复本、誊本的发行与返还责任等四个部分。

The construction of a civil liability system in Commercial Instrument Law is of great significance to the benefit of relieve bill obligee, to the punishment of illegal bill activities and to the completion of bill legislation. The frame system of civil liability in our national Commercial Instrument Law includes four parts: bill return liability, benefit return liability, damage compensation liability, and issue and return liability for the copy of original bill and stencil.
