The Starting Point and Mechanism of Supervising Administration and Its Realization

实现行政法治的基本途径是通过有效的监督机制对行政权进行监督制约。为此 ,必须确立行政权是一种有限的权力之观念。对行政权的监督应当从“以权力制约权力”和“以权利制约权力”两个方面着手 ,确保监督权力的独立性、可行性 。

The basic way to realize the administrative legality is to supervise and check the administrative power through effective supervising mechanism. So an idea that administrative power is a kind of limited power must be established. The supervision over administrative power should be conducted in the following two aspects: 'using power to check power' and 'using right to check power' to safeguard the supervising power to be independent and feasible. Corresponding supervising procedure should be made to guarantee it.
