摘要
鉴定人的诉讼地位是鉴定人制度的关键问题,它决定了鉴定人制度如何建构。从这个角度对我国鉴定人制度的立法现状进行探究,结合对两大法系鉴定人地位的考察,界定了我国的鉴定人的诉讼角色,并以此为基础提出了建立我国鉴定人制度的初步构想。
The appraiser's position in the lawsuit is key to the appraiser system which determines the structure of appraiser system. This paper addresses the present legal state of appraiser system in China and defines the appraiser's role in the lawsuit in China with a primary framework on which to establish the appraiser system.
