摘要
随着2008年《劳动合同法》的正式实施,试用期制度也愈加完善,弥补了《劳动法》的诸多不足,其"倾斜保护劳动者"的立法宗旨使得有关试用期制度的规定明显地对劳动者从宽,对用人单位从严。立法的出发点是基于实践中劳资力量的严重不均衡,面对就业压力,劳动者明显处于弱势的一方,但对试用期制度的完善局限于对原有规定的细化,而非根本上的变革,试用期制度的相关规定在实践中并没有得到很好的落实,劳动者依旧经常陷入试用期陷阱,其合法权益的保障并没有得到根本性的改观。这种情况应从我国试用期制度的立法现状出发,通过明确试用期的期限和次数、试用期的工资标准、"不符合录用条件"等来解决这一问题。
As a special stage of the labor contract,the probation system is of great significance for striking a balance between the interests of both the establishment and maintenance of harmonious and stable labor relations. With the formal implementation of the"Labor Contract Law" of 2008 ,the probation system has become even more perfect,which makes up for the disadvantages of the "Labor Law" and tilts the protection of workers in legislation that making the provisions of the relevant probation system leniency workers,strict employer. The starting point of the legislation is based on the serious imbalance of the labor force in the practice,and the face of the pressure on employment,workers obviously disadvantaged party. But perfect for the probation system is limited to the refine-ment of the original provisions,rather than a fundamental change. The relevant provision of the probation system in practice and good implementation of the laborers still often fall into the trap of the trial period. The protection of the legitimate rights and interest has not been fundamentally changed. We should departure from the legislative status quo of China's period probation,through the probation period and times,probation salary standard to solve this problem.
