司法政策执行视阈下刑事裁判文书“部分上网”问题

Study on the “Partial Internet Access” of Criminal Judicial Documents from the Perspective of Judicial Policy Implementation

在最高人民法院有关裁判文书"应上尽上"的话语之下,刑事裁判文书仍面临着"部分上网"的问题。这一问题具有相当的惯性,并未因最高人民法院不断强化政策的推进力度而有根本改观。对此,客观技术原因已经不能很好地解释这一现象,而必须从司法政策执行的一般逻辑中加以考察,应从组织立场偏差、司法科层关系以及利益风险均衡等角度加以理解。正是上述因素造成了下级法院(法官)对刑事裁判文书"应上尽上"这一司法政策的普遍排斥、消极选择与变通执行。为了解决刑事裁判文书"部分上网"问题,未来应协调好上下级法院之间的组织立场偏差、完善刑事裁判文书上网的技术控制措施、强化"部分上网"的负面监督机制。

Under the discourse of the Supreme Judicial Organ regarding that the judicial documents 'should be uploaded if possible', the criminal judicial documents are facing the problem of 'partial Internet access'. This issue has considerable inertia and has not been fundamentally changed by the continuous strengthening of policy implementation by the supreme court. Thus, objective technical reasons can not explain this phenomenon well. It must be examined from the general logic of judicial policy enforcement, from the perspective of organizational bias, judicial bureaucratic relations and balance of interests and risks. It is precisely the above factors that have caused the lower courts(judges) to generally reject, passively choose and adapt to the judicial policy of 'should be uploaded if possible'. In order to get out of the predicament of 'partial Internet access' of criminal judgment documents, we should coordinate the deviation of organizational positions between the upper and lower courts, improve the technical control measures for criminal judgment documents online, and strengthen the negative supervision mechanism of 'partial Internet access'.
