摘要
在 2 0 0 0年 ,安徽省交通厅提出了“交通发展社会化 ,基础设施商品化、投资主体多元化、公路建设市场化、管理模式多样化”的方针 ,建设“六大工程”,开始尝试运用类似于 BOT的方式进行招商 ,先后有 6条高速公路项目成功引资。本文仅为这些项目在谈判、运作过程中的一点思考 ,讨论政策法律环境、实质性条款、综合补偿机制、市场选择机制、约束机制、退出机制、监督评价机制等 ,希望借此能推动我国高速公路
In 2002, Anhui Provincial Communications Department brought about the policy of “Socialization of communications development, commercialization of infrastructure, pluralistization of investment, marketization of highway construction and multiplication of management mode”, and tried to apply the mode similar with BOT to attract investment. And as a result, 6 expressways in Anhui have successfully attracted investment. This paper covers the consideration for these highway projects in the process of negotiation and operation, discussion on policy and legal environment, practical clauses, comprehensive compensation mechanism, market selection mechanism, control mechanism, retreat mechanism and supervision and evaluation mechanism. etc. The authors hope to accelerate the process of regulated expressway operation in BOT mode in China.
