甲指分包模式下承包合同风险研析及防范

Study and Protection About the Risk of Construction Contract Terms Referring to Project Employer's Subcontractor

通过对甲指分包管理模式下工程承包合同的详细研究分析,利用归纳的方法,找出了总承包方对甲指分包的管理、配合过程中同时所伴有的两种风险:管理超限风险和具体工作配合超限风险。从合同关系及相关条款出发,再根据分析有针对性地拟定应对措施进行防范,这样可达到合理规避风险和有效维护自身正当权益的目的。

By detailed study and analysis about management terms of project construction contract referring to project employer's subcontractor,using inductive methods,it finds out that two types of risks,the risk of management overrun and the risk of specific work overrun,very probably exist in the process of general project contractor managing and coordinating with the special subcontractor. Then according to the analysis from the contractual relationships and related contractual terms,using the analysis,it can adopt some prevention measures to achieve reasonable risk aversion and the purpose of effectively safeguard legitimate self rights and interests.
