Defend for the Folk Law

本文是关于民间法批判研究的再批判,也就是说,针对的是现有民间法的批判成果,但最终是回归到民间法本体的研究。具体而言,本文主要指出现有民间法批判的误读及原因,所作的研究是评价性的,主要目的在于从再反思的角度,对现有民间法批判研究作一番学理上的解读,最终目的是对民间法作一个全面、客观的评价。

This paper is about the critical studies of folk law to criticism,that is,against the existing folk law criticism of achievement,but in the end is the return to folk law ontology research.Specifically,this paper points out that the existing folk law critical misreading and reasons of the research is evaluated,main purpose is to the point of view of the reflection again,the current critical studies of folk law for a scientific interpretation of the main objective is to folk law for a comprehensive,objective evaluation.
