LegalSystem Construction and Steering to Right after Formation of Socialist Legal System with Chinese Characteristics

中国特色社会主义法律体系的形成肯定了改革开放以来我国法制建设的成绩,但我们也应当看到对现行法律体系缺陷认识不足,立法的重点方向把握不清、法律体系内部的矛盾冲突与法律缺乏可操作性仍是我们面临的问题。突破固有的研究范式,维持法学研究的独立性,就必须引入权利视角,将权利转型作为法制建设中的独立体系。权利体系推动宏观方面进一步完善法律体系,微观方面与时俱进地修订滞后法律。提高法律的可操作性和立法的科学性成为今后的工作重点,以实现从有法可依到有法必依,确保公法对社会主义法治建设的立法保障,并将权利作为法制建设的标准,实现现代法治的权利转向。

The performance of our legal system building has been approved by the formation of socialist legal system with Chinese characteristics after reform and openness.However,it should be recognized that we are facing a serious of problems such as lacking the aware of the defects of the present legal system,confusion over the direction of legislation,conflicts within our legal system,and which lack of enforceability.Basis of right should be introduced for we must breakthrough inherent paradigm as well as maintain the independency of law research.Then,regard the transition of right as an independent system in our legal system building.rights system can promote the perfection of legal system on the macroscopic aspect and revise outdated laws on the microscopic aspect.Moreover,to improve the enforceability of law and to make legislation more scientific would be the next focus.By this,we can make the laws be observed and strictly enforced,ensure the public law as the legislative guarantee to the legal construction,regard the right as the standard of our legal system building,and so make the modern rule of law steer to right.
