少数民族法制建设研究的现状与反思——透过学术论著的审视

The Status and Reflection of Construction of Legal System on Minorities:Through the Existing Literature Investigation

目前,少数民族法制建设研究较为丰富,主要分布在少数民族法制建设一般研究、民族区域自治研究、杂散居少数民族法制建设研究、少数民族法制建设中重点人物的理论与实践研究、少数民族法制建设基本范畴研究、少数民族法制建设具体范畴研究、少数民族法制建设其他范畴研究、各地少数民族法制建设研究、各少数民族法制建设研究九个方面。但是,这些研究仍然存在一定的问题:基础理论研究数量、深度不够;研究对象主要集中在民族区域自治方面,相对忽略了杂散居少数民族的法制建设;研究方法主要运用语义分析、实证研究等方法,而历史学等其他社会科学方法运用较少。

Currently,the construction of legal system on minorities is abundant,which is mainly concentrated in nine areas,includes general study on legal construction of minorities,study on Ethnic Regional Autonomy,study on legal construction of legal system of Miscellaneous Diaspora Minority,theory and practice on key figures in construction of legal system of minorities,research on basic areas of construction of legal system of minorities,research on specific areas of construction of legal system of minorities.research on other areas of construction of legal system of minorities,research on construction of legal system of minorities in different regions,research on construction of legal system of various minorities.However,there are some problems in existing research;for example,lacking in the depth and quantity in basic theory research,study focused on regional ethnic autonomy and the relative neglecting on legal construction of legal system of Miscellaneous Diaspora Minority,the main research method focused on using semantic analysis,empirical research and the relative neglecting on other social scientific method which include the history.
