随着科技的迅猛发展,人工智能被广泛运用于各个领域。自动驾驶汽车的出现,革新了现有的人车关系和交通行业规则。许多国家对自动驾驶汽车的研发都趋于成熟,陆续进入路面测试阶段。在技术难关被逐步攻克的同时,其给法律制度却带来巨大的冲击。我国自动驾驶汽车的上路行驶将改变现行《道路交通安全法》涉及的诸多具体规范。因此,面对自动驾驶汽车的诸多挑战,必须完善通行主体规范、执法规范、事故处理规范和违法处理规范,从而对《道路交通安全法》进行变革以进行积极应对。

With the rapid development of science and technology, artificial intelligence has been widely used in various fields. The emergence of self-driving vehicles has revolutionized the existing relationship between people and vehicles and the rules of the transportation industry. The research and development of self-driving vehicles in many countries is becoming mature and has entered the road test stage successively. While the technical difficulties have been gradually overcome, the legal system has been greatly impacted. China’s self-driving cars on the road will change the current 'Road Traffic Safety Law' involved in many specific norms. Therefore, in the face of many challenges posed by self-driving cars, it is necessary to improve the norms of passing subject, law enforcement, accident handling and illegal handling, so as to reform the 'Road Traffic Safety Law' to respond positively.
