摘要
邓肯·肯尼迪认为美国法学院本身即是一个存在着压迫与反抗的权力体系,完全是美国社会权力结构的再现。法学院迫使学生适应这个体制,而不是批判或者反抗;事实上,大多数学生也主动接受了它的规训。通过分析学生和教师的心态,以及授课方式、课程设置的政治意涵,肯尼迪得出结论,对社会的政治改革可以而且应该从对法学院的改革(甚至是革命)开始。
Kennedy points out that law schools in United States are power-institutions full of oppressing and rebelling.Law schools force students to comply with their orders,rather than criticizing or fighting against them.In fact,most students voluntarily accept to be disciplined.By analyzing students and teachers’psychology,also political meanings of teaching methodology and courses configuration,Kennedy concludes that the political reform of society may or should begin with the reform,even revolution,of law schools.
