1998年5月6日,日本政府效仿美国制定了《大学技术转移促进法》,规定了有关技术转移机构的基本制度政策,旨在加速大学研究成果向民间机构转移,从而增强日本的经济活力。日本技术转移机构的基本法律《大学技术转移促进法》是日本大学技术转移机构的基础,技术转移机构、大学和大学衍生企业三者之间的结构为基本框架,职务发明制度与技术转移机构的动态关系是最新发展。最后,通过对若干问题的分析指出对我国的借鉴意义。

May 1998,upon the implementation of the Act on the Promotion of Technology Transfer from Universities to Private Business Operators 9 the Japanese government has followed the U.S.example,aiming at the promotion of technology transfer towards private business operators,and in turn to enhance its economic vitality?The majority of this paper consists of a thorough analysis of the said act,the relationship between technology licensing organizationt colleges,and the spin-off companies,as well as how modification of employee invention system influences on technology transfer,the end of the paper raises the question of harmonization,and contains an analysis on the revelation to the Chinese policy?
