论集体土地所有权的政治伦理属性与法律属性

Study on the Political Ethics Properties and the Legal Nature of Collective Land Ownership

集体土地所有权的政治伦理属性显示集体土地所有权中渗透着传统社会主义的政治理想,是兑现中国共产党与农民群体在新民主主义革命中缔结的政治契约的重要环节。从集体土地所有权制度运行的现实状况来看,集体土地所有权既不是一般意义上的共同所有权,也不是一种由单一主体享有的所有权,而是'集体成员集体所有'的所有权形态。集体土地所有权与总有非常类似,但不应当被界定为总有。虽然目前集体土地所有权不宜被界定为法人所有权,但是集体土地所有权在城镇化进程中表现出来的持续法人化趋势值得继续被关注与研究.

The political ethics properties of collective land ownership show that the collective land ownership is in relation with traditional socialist political ideal and it is core of realizing the political contract between peasants and the Communist Party of China in democratic revolution.From the perspective of the reality,collective ownership of land is neither a general sense of joint ownership nor a single subject ownership,but is the form of'collective members ownership'.From the perspective of comparative law,the collective ownership of land and total ownership are very similar,but it should not be defined as total ownership.Although the ownership of collective land ownership should not be defined as ownership of juridical person,but the process of continuous corporate trends of it in the urbanization should be concerned.
