人工智能与侵权责任之冲突及应对——以自动驾驶汽车为例

摘要 本文通过假设四种可能会在自动驾驶模式下发生的场景探讨相关的侵权责任。原则上应由自动驾驶汽车技术制造商对事故承担责任,同时依据司机的不同类型与其阻止事故发生的能力大小在当事人之间按比例分配责任。通过对具体场景的分析,本文认为专心的司机需要对大多数的事故负责,驾驶能力不足的司机和分心的司机应对事故承担部分责任,而身体有障碍的司机在自动驾驶模式下发生的事故由制造商负全责。 In this paper,we will discuss the related tort liability by assuming four scenarios which may occur in the automatic driving mode.In principle,should by self-driving cars technology manufacturers take responsibility for the accident,at the same time,according to the different types of drivers and its ability to prevent the accident size between the parties in proportion to allocate responsibility.Through the analysis of the specific scenario,this paper argues that the attentive driver need to be responsible for the majority of the accident.The diminished capabilities driver and the distracted driver should shoulder some of the accident liability,and the disabled driver in autonomous mode accident responsible by manufacturers.
