摘要
日本森林资源丰富,林业管理体系健全。文中首先通过整理日本政府主管部门公布的日文资料,介绍日本民有林流转市场近况,得出林地流转在宗数、面积及每宗林地流转平均面积方面的变动趋势;其次,从事后备案制、差异化税收价格计算制度和征收标准以及对外国资本购买日本民有林地实行的事先审批制3个方面分析日本民有林流转制度;最后建议我国将森林纳入不动产管理时应建立不动产管理部门与森林管理部门的协作机制,并在进行集体林权流转时完善监管体系。
Japan boasts abundant forest resources and a sound forestry administration system.This paper reviews the statistical data and documents on the non-public forest transfer market published by the forest authorities of Japan,and concludes the trends in numbers,areas,and average areas of forest transfer in Japan.The paper then analyses the non-public forest transfer system from 3 aspects of Post Filling System,differentiated taxation pricing system and collection standard,and Prior Approval System for the transfer invloving foreign capital.The paper finally suggests that China shall set up a collaborative mechanism between real estate administration and forest management administration for managing forestland as a real estate property,and perfect the supervision system for collective forest tenure transfer.
