20世纪20年代,恐惧红色革命和害怕移民潮是造成美国司法史上声名狼藉的萨科审判事件的主要成因和历史背景。在对审判中的标准和依据进行司法解读之后,得出了两位意大利无政府主义人士萨科和樊塞蒂是被冤判的结论,法官和陪审团因为两人的政治信仰和移民身份产生的主观偏见导致了最后的死刑判决。左翼作家厄普顿·辛克莱尝试从抗议者的视角重述这一则众说纷纭的历史事件,通过小说《波士顿》的叙事,参与言说历史并对当时社会运作的内在逻辑与政治生态进行了诠释。
The paper focuses on one of the most notorious trials in American legal history,Sacco and Vanzetti Trial,and analyzes the historical background of the trial,namely the 1920 s when Red Scare and migrant wave scare were haunting American people.After examining closely the evidence and reasoning of the trial,the paper draws the conclusion that the two defendants Sacco and Vanzetti were wrongly accused of the crimes they did not commit and the reason for their capital punishment was the prejudice of the judge and the jury against their political belief and migrant identity.The leftist writer Upton Sinclair recreates the trial in his historical novel Boston from the perspective of those who want to return justice to the two misjudged anarchists and elaborates the inner logic and political ecology of the case.
