摘要
英国教师惩戒权的发展从探索到日趋完善经历了全面禁止体罚、恢复教师惩罚权力、出台《2006年教育与督学法》和出台《学校中的行为与纪律》四个阶段。然而在我国,教师惩戒权的实施并没有明确的法律法规支持,使用的过程中也面临着滥用教师惩戒权和教师惩戒权缺失两大问题。对比英国教师惩戒权的发展,吸收其经验教训,我国教师惩戒权的发展在制度、实施、管理和使用层面必须做到明确立法、完善程序、灵活惩戒和沟通合作。
Development of the punishment power of teachers in UK had experienced completed prohibit corporal punishment, restored teacher's right to punish, introduced the Education and the superintendent of 2006 and introduced the Behavior and discipline in schools this four stages from exploration to maturing. However, there is no clear legal to support the punishment power of teachers in China, the process of using this power is also faced with two major problems such as the abuse of the punishment power of teachers and the absence of the punishment power of teachers. Comparing with the development of the punishment power of teachers in UK, absorbing its lessons, the development of the punishment power of teachers in our country must clearing legislation, improving procedures, flexibility in the use of punishment, communicating and cooperation in the four aspects of system, implementation, management and use levels.
