论地方立法对《立法法》修订内容的践行

第十二届全国人大通过了修改《立法法》的决定,修订后的《立法法》在立法理念、机制、程序等方面都有较大改变,特别是地方立法主体将大幅度增加,地方立法工作面临一系列新情况、新问题。突出人大立法主导地位、力促民主立法、确保科学立法是今后地方立法应遵循的基本理念。地方立法主体应不断完善立法的过程机制,应建立立法工作队伍的良性生成机制,应优化地方立法中的"改废释"机制。地方立法主体在实施《立法法》过程中,对明确可操作的规范内容应及时全面履行,对弹性模糊之处应依法理、上位法等及时廓清内涵,补其不足;应对本行政区域内地方性法规进行实质性事前监督,也应对相关政府规章进行主动的事后审查,确实维护地方法制的统一。

The Twelfth National People’s Congress passed the decision of amending the Legislation Law. The amended Legislation Law has been changed greatly in the aspects of legislative concept, mechanism, procedures and so on. Especially the local legislative responsibilities will be increased by a big margin and the local legislative work will have to face a series of new situations and problems. Highlighting the legislation dominant position of the National People’s Congress, speeding up democratically legislating and ensuring scientifically legislating are the basic ideas that the local legislation should follow in the future. The main body of the local legislation should constantly improve the process mechanism of legislation, establish a sound renewal mechanism of legislative work team, and should optimize the mechanism of "legislation, amendment, abolishment and interpretation" in the local legislation. In the process of implementing the Legislation Law, the main body of local legislative should give timely and overall performance for the specific operative normative content in the the Legislation Law; it should timely mine out the connotation and make up for the deficiency according to the legal principle and the upper law as far as elastic ambiguities are concerned; it should make a substantive and prior supervision for the local regulations in the administrative region, and should make an active following-up examination of the relevant government regulations and ensure the unification of local legal system.
