On Conditions for Realizing the Social Functions of Law Scholars

法学学者如果能以该当姿态积极作为,那么必对法治建设发挥最佳作用。法学学者能否实现其生产法学知识、型构社会规范、培育法治文化等社会功能,取决于政治性、社会性、专业性、主观性四个条件是否齐备。政治性条件即政治家的执政理念与法治意识,社会性条件即社会公众在生产、生活和文化等方面的发展水平和模式,这两个条件法学学者只能通过间接方式影响其他主体以促成。专业性和主观性条件则应由法学学者独自承担促成责任。

Law scholars will play the best role in the legal construction if they involve themselves in the attitude of responsibility.Whether law scholars can realize their social functions of law knowledge production,social norm formation,cultivating law culture,among others,is determined by the four conditions:political,social,professional,and subjective.The political condition is concerned with the executive conceptions and legal consciousness of politicians,and the social condition consists of the level and mode of development of the general public in production,life and culture.Both conditions can only be promoted by law scholars in an indirect way.However,professional and subjective conditions are the responsibilities that law scholars should take.
