比例原则在警察行政执法中的适用研究

Application Study of the Proportion Principle which the Police Administratively Enforce Law

我国警察行政执法注重效率、自由裁量权过大的现状与法治社会要求的限制公权力、保障人权相去甚远。笔者通过对比例原则和我国警察行政执法现状提出:把比例原则定位在行政法基本原则的层面,将其作为规范警察行政执法具体可操作的一般法律原则,用来限制警察权以保障人权,并试图从立法、执法和司法层面探寻让警察行政执法回归比例原则的可行路径。

The current situation that China’s police focuses on efficiency in the administrative enforcing law and the too big discretion power is far from the restriction public power and human rights protection of legal society requirement.By analyzing the proportion principle and the current situation which the police administratively enforces law,this author proposes that locating the proportion principle in the basic principle level of administrative law,regarding it as a specific practical general law principle that regulating the police to administratively enforce law,and restricting police power and protects human rights,then explores the workable route to regressing the proportion principle which the police administratively enforce law from the level of legislation,enforcement law and administration of justice.
