论中国司法参与国际经济规则的制定

On China's Judiciary Participation in the Formulation of International Economic Rules

党的十八届四中全会指出,积极参与国际规则制定,增强中国在国际法律事务中的话语权和影响力。随着中国国际地位的提升,参与制定国际规则已经成为中国特色社会主义法治建设的历史重任,其中司法参与不可或缺。中国参与国际经济规则的制定是国际经济关系民主化的时代要求,是中国对外开放新体制建设的客观需求,也是国际法治和国内法治互动的必然需要。中国应当积极参与国际治理,并借助国际治理推动国内法治建设;着力克服国际法高端人才稀缺、重大课题研究不深入、对国际规则研究不够等制约因素和参与国际规则制定的局限性;高度重视内国司法审判对国际经济规则制定的影响,积极发挥内国司法对国际条约的适用与解释、对国际习惯和一般基本原则运用的累积和沉淀以及填补国际法空白的功能,推动国际法治发展进程。当前,中国司法审判要努力抓住"一带一路"建设机遇,积极参与国际经济规则的制定,推动国际规则的创制与完善。

The Fourth Plenary Session of the 18 th Central Committee of the Communist Party of China pointed out that China should take an active part in the formulation of international rules,enhancing China’s voice and influence in the international legal affair.With the rising of China’s international status,participating in the formulation of the international rules has become a great historic mission for China to construct socialist rule of law with Chinese characteristics,among which the judiciary participation is indispensable.China’s involvement in making international rules meets the requirement of the democratic process of international economic relations,the construction of new openness system of China,and the necessary request of interaction between international and domestic rule of law.China shall positively take part in the international governance,and promote the domestic construction of rule of law with the help of international governance.In order to participate in the development of international rule of law,China shall focus on how national judicial trial can influence the international rules formation,particularly how national judicial authorities can apply and interpret international conventions and furthermore complete the blank of international law.Currently,Chinese judicial authorities should take the great opportunities of the construction of the'One Belt and One Road',take part in the formulation of international rules,and strengthen the international rule of law.
