建设人类命运共同体作为新时期中国外交事务的重要指导思想,蕴含着深刻的国际法思想与内涵。全球化发展进程中,不断加强的国际社会共同利益,是人类命运共同体建设的物质基础。基于主权又超越主权的国际社会本位理念,是人类命运共同体建设的思想基础。实现国际社会正义,达成形式正义与实质正义的平衡,是人类命运共同体建设的道德基础。为了减少世界各国交往的法律障碍,各国法律趋同化发展,是人类命运共同体建设的国内法路径。国际法律制度的建立和国际组织的发展,有力地促进和维护了世界和平,但未能实现永久和平。国际法应更加重视人的内心和平的建设,从而实现世界的永久和平,这是人类命运共同体建设的国际法新途径。建立在传统文化和国际法基本原则基础之上的中国和平崛起,是对人类命运共同体建设的独特贡献。

International law is to be needed to help to construct the community of common destiny for mankind. According to the development of globalization,the common interest of international society is continued to be strengthened and become the material basis to construct the Community of common destiny for mankind. The doctrine of International-Community-Orientation which is based on but beyond sovereignty is the thinking basis. Its moral basis is to realize the justice of international society and get the balance between formal justice and substantive justice. In order to reduce the obstacles of communications among countries,the assimilation of law is developing and becomes the way of domestic law. International law and international organizations have promoted and maintained the peace of world but almost haven' t realized the perpetual peace of the world. There is a new method for the international law to regard the inner peace construction of human beings as a more important issue which is easier to realize the perpetual peace of the world. The peaceful rise of China which is based on the traditional Chinese culture and primary principles of international law is the specific devotion to construct the community of common destiny for mankind.
