我国目前的企业立法体系极为混乱,存在传统和现代两种相互矛盾和冲突的立法体系, 使我国企业立法多元、无序,严重的背离平等、公平竞争的市场经济和全球化普遍"国民待遇原则 ",必须从建构理性主义的高度,以企业责任形式和组织形式的标准来重构我国企业立法体系,从统一公司法修改合伙企业法,完善独资企业法等角度不断稳步推进,构建出和谐、严谨和科学完善的企业立法体系,不断完善社会主义法制。

In China, at present, there is an extremely confused legislative system of enterprise, which is a contradiction and a conflict between the traditional legislative system and the modern one, which makes China’ s legislation of enterprise multiple, disordered and seriously deviates from the market economy and the common "principle of national treatment" in the world for equal competition. Judged by constituting the height of rationalism, we must reconstitute the legislative system of enterprise in our country in accordance with the responsible form of enterprise and the standards of organizational form. Proceeding from the united company law, we must amend the business law for partnership to perfect the business law for sole proprietorship. In this way, we can continuously promote and constitute the legislative system of enterprise, which is harmonious, rigorous, scientific and perfect, and further improve the socialist legal system.
