在网络环境中,数字图书馆与社会公共利益冲突给知识产权尤其是著作权的保护带来新的挑战。为了更好的协调数字图书馆、著作权人、读者三方的利益,有必要引入一些新的原则制度进行探讨:著作权集体管理制度,以公共借阅权取得授权,完善数字图书馆著作权保护的技术措施,从而实现网络著作权的有效保护。

In the environment of the network, the conflict between the digital library and social public benefit brings new challenge to intellectual products rights, especially to copyright. In order to better coordinate the relationships between the digital library, copyright-owned persons, and readers, it’s necessary to introduce some new principles such as: copyright collective management, the authorization of the public reading right, the perfection of the protection technology of digital library copyright. Therefore, the internet copyright can be effectively protected.
