民事裁判错误问题研究——以法律救济为视角

Study on Mistakes of Civil Judgment——Discussion on the Aspect of Legal Relief

民事裁判错误作为民事诉讼过程中不可避免的客观存在,对其进行相应的司法救济应是一个亟需关注的论题。但是,目前理论界对此问题的关注却并不到位。以法律救济为视角,针对现行民事裁判错误法律救济存在的问题,对其进行根源探究并提出相应的解决措施以及完善构想,以期对现行民事诉讼法的修订与完善有所裨益。

As ineluctable and objective existence in civil actions,mistakes of civil judgment should be given enough corresponding legal relief.However,in the field of legal theories,less concern has been focused on this matter.Taking the legal relief as the angle of view,this paper aimed at the current problems existed in the mistakes of civil judgment,and put forward corresponding measures and complete ideas so that to be beneficial to the amendment and improvement of the current civil law.
