弱势群体接受高等教育权的保护制度分析——以恢复性司法为视角

Analysis on Protection System of Vulnerable Group’s Rights to Higher Education——from Perspective of System Law

目前我国弱势群体在高等教育中受教育权保护制度存在效力过低、制度建构的缺失、制度缺乏系统性等问题。在高等教育阶段,要实现对弱势群体受教育权的保护,必须把立法、执法、司法放到一个系统内考虑。形成运作的自成一体的价值基础;形成闭合的受教育权法律保护制度;形成一体化的保护制度。

At present,vulnerable groups’rights to higher education protection system in China have problems as too low effectiveness,absence of institutional structure and lack of system.At higher education stage,to protect the vulnerable group’s rights to education,legislation,law enforcement,administration of justice should be considered in one system.Operating and self-contained value basis,closed system of legal protection of the right to education,integrated protection system should be formed at the same time.
