浅议山区的法律界定

Discuss on Legal Definition of Mountain Area

山区为人类生存提供了主要资源。然而,随着经济技术的迅速发展,山区环境却不断退化、生物多样性和文化多样性被破坏、山区发展滞后和贫困化已成为全球关注的热点问题。山区可持续发展立法已经成为了一个全新的世界性发展趋势,有学者在剖析我国山区发展过程中出现的问题时提出要制定一部《山区法》或《山区资源综合开发与保护法》。通过综合我国学者从自然科学角度和人文社会科学角度所做出的定义,并借鉴国外山区法中对山区进行定义中所采用的各种标准,从法律角度对我国山区进行界定。

Mountain area provides major resources for human survival. However, with the rapid economic and technological development, degradation of mountain environment, biological and cultural diversity, destruction and impoverishment of the underdeveloped mountainous areas have become a hot issue of global concern. Sustainable development legislation in mountain area has become a new worldwide trend. When analyzing problems in the development process of China’s mountain area, some scholars put forward that a "mountain law" or a law of "comprehensive development of mountain resources and protection" should be drafted. From a legal point of view, China’s mountain area was defined through an integrated perspective of natural science and humanities and social science made by Chinese scholars, and different standards used in mountain law abroad.
