隐藏行为是指表意人为虚假的意思表示,但是其真实的意思表示是发生另外法律效果的法律行为,在性质上属于瑕疵意思表示。隐藏行为的构成要件包括:行为主体为表意人与相对人、存在虚假的意思表示、对隐藏的真实意思明知以及虚假的意思表示与隐藏的真实意思不一致。"以合法形式掩盖非法目的"仅仅是隐藏行为的一种,隐藏行为的存在必须以虚假行为为前提,如果不存在无效原因并且不产生无效后果,那么恶意串通行为一定无效。隐藏行为在实践中典型的类型有:名为买卖实为借贷、名为买卖实为赠与、名为联营实为借贷、借名借款和借名买房等等。

Hidden acts refer to the expressions of intent that mean artificial falsity,but the true expression of intent is a legal act with other legal effects,which belongs to defective expression of intent in nature. The constitutive elements of concealed acts include: the subject of the act being the ideographic person and the relative person,the existence of false expression of intention,the knowing of the true meaning of concealment,and the inconsistency between the false expression of intention and the true meaning of concealment. ' Covering up illegal purpose in legal form' is only one kind of concealment. The existence of concealment must be premised on false act. If there is no invalid cause,it will not produce invalid consequences,so malicious collusion must be invalid. The typical types of hidden behavior in practice are called buying and selling as lending,buying and selling as gifts,joint venture as lending,borrowing under name and buying houses under name,etc.
