摘要
小产权房的购房者在购买房屋后不能取得房屋所有权,不能享有相应的权利。小产权房介于农村集体用地和城市建设用地之间的模糊地带,法律一直未对小产权房问题明确表态。这使现实中大量存在的小产权房既不受规制又得不到保护。以实证调查方法为基础,通过走访江西省乐安县,考查当地移民村建设与使用中滥用集体建设用地的情况。并以此为基础探讨我国小产权房应当合法化以及合法化途径的问题。
The vendee will not get premises permit if buying a limited property right house.Accordingly he cannot enjoy homeownership rights.The law has not given a clear definition of those limited property right houses.Therefore this kind of houses cannot be well regulated or protected.This paper,based on empirical study and interview in Le'an county,investigates the situation of the construction of immigration villages and the abuse of collective-owned land in order to find a solution to legalize the houses of limited property right.
