摘要
1804年《法国民法典》是编纂者以自然法思想为主要理论指导,对罗马法、习惯法、王室法令、教会法和大革命法制进行选择、折衷和发展的成果。其中,自然法思想发挥着精神内核的作用,成为《法国民法典》各项具体制度构建的重要思想渊源。该文试图通过考察民法典立法指导思想以及具体构建中的自然法思想印记,揭示自然法对于民法典的深刻影响。
Theoretically guided by the thought of natural law, The French Civil Code of 1804 was compiled by selecting, compromi-sing and developing the Roman law, customary law, Royal Decree, Cannon law and French Revolution legal system. Among them, the thought of natural law serves as the spiritual core, becoming an important source in the construction of all these legal systems of The French Civil Code. This paper tries to reveal the profound influence of natural law on civil code by investigating the legislative guiding ideology of civil code.
