论高职院校的注意义务——以学生顶岗实习伤害事故为视角

The study on the duty of care of Higher Vocational Colleges in student injury accident during the practice of internship

顶岗实习属于高职院校教学内容的延伸,学生在顶岗实习过程中发生伤害事故属于学生伤害事故的一种类型。从侵权责任法角度分析,如果高职院校在安排、管理学生顶岗实习过程中存在过错,没有尽到注意义务,应对遭受人身损害的学生承担侵权责任。高职院校在学生顶岗实习过程中负有选择良好合作企业的义务、与实习企业签订协议的义务、对学生到企业顶岗实习的整个过程负有组织、管理及监督的义务、购买保险的义务及救助的义务且注意义务应达到"合理人"的注意标准。

Practice is a key teaching link in higher vocational education.The student suffered a personal injury during the practice of internship is one kind of student injury accident.If higher vocational colleges do not fulfill the duty of care,it should assume tort liability while student suffering a personal injury.Higher vocational colleges have the obligation to choose good cooperative enterprises,sign the agreement with enterprises,organize,manage and supervise the students during the whole process of practice,buy insurance and help students while they are in danger.All of the duties of care taken by higher vocational college should reach the standard of care 'reasonable man'.
