TPP在知识产权保护制度的新发展及我国的对策

A Study on Tendency of Intellectual Property Protection under Trans-Pacific Agreement and Countermeasures

正在谈判中的跨太平洋伙伴关系对于知识产权保护采取了高标准、强保护的策略,这意味着以美国为主导的TPP谈判试图建立一个远高于TRIPS及其他国际知识产权协定的保护制度。一旦TPP最终签署,很可能以国民待遇、最惠国待遇扩大适用于成员国外的贸易协定中,短时间内将对我国形成知识产权贸易壁垒,长期则会促进我国知识产权制度的完善。对此情况我国应当跟踪并研究TPP最新动向,完善我国知识产权保护制度才能最大限度降低TPP对我国的不利影响。

Trans-pacific Partnership Agreement adopt high standard for intellectual property protection,it means American try to establish a higher standard than TRIPS or other Agreements.Once final signing,TPP will affect other Agreements because of National Treatment and Most-favored-nation Treatment.It will be barriers for China,but will promote intellectual property system for long time.We should follow and study TPP,improve intellectual property protection and minimize impact for our country.
