取缔非法社会组织面临的困境与对策

取缔非法社会组织,是维护社会秩序的重要手段。我国现行的双重审核与管理手段,决定了对非法组织的认定与取缔存在着困境。应从形式与实质两方面对非法社会组织进行界定,以明确取缔对象;明确取缔性质,统一取缔认识;建立健全立法体系,统一取缔标准;规范取缔程序,加强行政执法。

Banning illegal social organization is an important way to keep social order. The current double check mechanism and administration make it difficult identify and ban the illegal social organization. Both formal and material facts should be considered in identifying process in order to confirm the object and the quality of banning,perfect the legal system and unify the standard of banning,improve the process and strengthen the administration.
