论中国民法典设立知识产权编的必要性

从实现中国民法典的基本功能、发展民法理论与制度、完善知识产权理论、便利知识产权实务的角度考量,应当在中国民法典中设立知识产权编。设立知识产权编的技术难度,是法典化的一般难度,不是知识产权编的特有难度。缺乏知识产权编,将是中国民法典的本质性缺陷,与之相比,设立知识产权编的技术难度是非本质的、是值得克服并可以克服的。

From the consideration of civil code basic functionality,development of civil law theory and system,improvement of intellectual property rights theory,and convenience of facilitating intellectual property practice,intellectual property series shall be established in the civil code. The technical difficulty to set up intellectual property series is a procedure part of the general difficulties of condition,rather than specific difficulties of themselvess. There will be a fatal defect if the intellectual property part is absent. By contract the technical difficulty to set up intellectual property series is unessential,worthy to overcome and able to overcome.
