在社会主义中国,民法典的编纂具有重要的作用和意义。以实证化寻求确定性的民法典,成为市民社会在政治国家中维持并发展自由的中介。民法典承载的自由为政治国家的存续合法性提供基础,为建立法权共同体提供支撑。

In socialist China,the establishment of Civil Code has its significance.By the positivistic of rights and duty,the Civil Code will get its certainty and become the intermediary of society and political state to maintain and develop.The freedom hosted by Civil Code can provide the legitimacy of existence for the political state,and also provide the foundation for the establishment of a Community of Droit.
