On Specific Object

特定物是民法上的一个重要概念,但对这一概念的认识却很混乱。我国大陆学者一般认为物为特定物或者种类物是由物的属性所决定的,笔者认为这一观点是导致对特定物认识混乱的根本原因。决定物为特定物的因素并不限于物的属性,与物相关的某些非物质性因素同样可以成为决定物为特定物的因素。

Specific object is an important term that confuses a lot of people. Scholars in the mainland of China hold that the specific object is determined by the attribute of an object, which is the basic reason for confusion about the term 'specific object'. The determinant of the specific object is not necessarily the attribute of an object, and some non-material factors may serve as determinants.
