On Reconstructing the Standard for Public Prosecution Proof——From the Perspective of the Proof Standard

廓清了证明标准与证明要求的关系,在"案件事实清楚,证据确实、充分"这一证明要求的旗帜下,从两个层次上对公诉证明标准进行了阐述,提出了"有足够证据"这一表述方式,并对如何具体把握作了进一步的探讨,以期从庞杂的证明标准体系中理出一点头绪。

This paper first distinguishes the standard of proof from the demand of proof. Then it explains the standard of public prosecution proof from two aspects based on the demand of proof that case facts are clear and proofs are conclusive and complete. Finally it puts forward 'sufficient proof' and further explores the approach to it in order to make the complex system clear.
