村民自治权与村民经济自主权

A Study of the Villagers’ Rights of Autonomy and Their Rights of Economic Autonomy

村民经济自主权是村民自治权的经济背景和制度支撑。村民自治运作中的问题 ,归根结底是经济制度上的问题。为此 ,必须改革目前农村集体财产所有权行使的制度模式 ,以农地使用权保障村民对土地资源的使用权益 ,以股东权调整农村集体经济组织的财产关系 ,使村民通过农地使用权和股权获得经济自主权 ,以独立的经济人格、独立的社会人格参与社区的村民自治。

The villagers’ rights of economic autonomy is the base of the villagers’ rights of autonomy. In the final analysis, the villagers’ autonomy depends on the economic systems. So it is very important that the villagers’ committees only exercise the public rights of villagers’ autonomy and the villages’ economic organics, exercise the rights of villages’ economy. To reach this purpose, we must reform the villages’ ownership of collective property and the village economic organics. The rights of use guarantees the villagers’ rights to agricultural resources, the rights of shareholder regulate the relationship of agricultural organics. So the villagers can acquire the independent personality in economy and society.
